This website is designed and managed by Infinite Recreations. It is assumed that the terms “we”, “us” and “our” refer to Infinite Recreations throughout the entirety of this document. All information, tools and services available from this site is offered to you, the user, conditioned upon your acceptance of the Terms and Conditions stated here.

 By visiting our site and/ or purchasing something from us, you agree to be bound by the following Terms and Conditions which is applicable to all users who visit this website.

1. Use of the Website

1.1. By accessing the website and all information contained in it, you confirm that you are legally entitled to do so and that you will not exploit any information contained on the website.

1. General Conditions

2.1. We reserve the right to refuse service to anyone for any reason at any time.

2.2. You understand that all your information shared on the website may be transferred unencrypted and involve transmissions over various networks. Furthermore, your shared information may be technically changed to conform to any technical requirements of sites and devices of any sort. The above is NOT applicable to Credit Card information, as any sensitive payment specific information (Credit cards, etc) is always encrypted during transfer over networks.

2.3. All users who access the website agree to not reproduce, duplicate, copy, sell, resell or exploit any information, downloads, products, or service provided by the Infinite Recreations team without written consent signed by all Directors. 

1. Accuracy and Timeliness of Information

3.1. Infinite Recreations ensures the customer that every effort is given to ensure that the information and content displayed throughout the website is accurate, true, and up to date. Should the customer find any information that may appear otherwise, we request that customer to contact us on admin@infiniterecreations.co.za.

1. Modifications to the Products/Services and Prices

4.1. Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Product/Service (or any part or content thereof) without notice at any time.

4.2. We shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Product/Service.

1. Products or Services

5.1. SmartTag Solutions, and all products and services provided under the SmartTag name are provided in its direct form exclusively by Infinite recreations. We will not accept responsibility for any loss/damage as a result of other products/services that may appear similar to and work in the same manner as our SmartTag Solutions.

5.2. We have the right, but are not required, to restrict the sale of our products or services to any individual, geographic area, or jurisdiction. We may choose to exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we provide. All descriptions of products or pricing are subject to change at any time, without notice, at our sole discretion. We have the right to discontinue any product at any time. 

5.3. Customers are encouraged to contact us whenever information has changed, so that the correct information is displayed when using the SmartTag Solution.

5.4. Customers are reminded that the SmartTag Solutions provided by Infinite Recreations requires an internet connection to function as intended, Infinite Recreations will not be held liable for any damage or loss incurred as a result of a product or solution provided by us not working due to lack of/no internet connection.

1. Payments

6.1. All SmartTag Solution products and services have different once-off costs, product costs, and monthly subscription costs. These costs are available to all customers beforehand and are readily available to any potential customer who signs up online. Kindly reach out to admin@infiniterecreations.co.za for assistance with these prices.

6.2 All customers who sign up to any SmartTag solution, agree to pay the monthly subscription. Any case whereby a customer fails to make payment will result in suspension of the customer’s profile on the applicable SmartTag product/service.

1. Accuracy of Billing and Account Information

7.1. We have the authority to decline any order you submit to us. At our sole discretion, we may restrict or cancel the quantities purchased per person, per household, or per order. These limitations may include orders placed by or under the same customer profile, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we modify or cancel an order, we may try to notify you by contacting the email and/or billing address/phone number provided when the order was placed.

7.2. When using this website, you agree to provide current, complete and accurate account information. You agree to promptly update your account and other information required to process any orders placed, so that we can complete fulfill your order and contact you when required.

1. Errors, Inaccuracies and Omissions

8.1. While we do our best effort to ensure correctness and error free content, there might be information on our site containing typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any of these discrepancies, and to change, update information, or cancel orders if any information on the website is inaccurate at any time without prior notice which may or may not include a customer’s order.

8.2. We undertake no obligation to update, amend or clarify information on the website, including without limitation, pricing information, except as required by law. No specific date referencing website content should be taken to indicate that any information on the website is updated. Infinite Recreations manages this website and reserves the right to may any and all changes as deemed necessary by the owners.

9.1. In addition to other restrictions outlined in the Terms and Conditions, you are prohibited from using this site or its content in the following ways: (a) for any illegal purpose; (b) to encourage others to engage in unlawful activities; (c) to violate any international, federal, provincial, state, or local laws, regulations, or ordinances; (d) to infringe on or violate our intellectual property rights or those of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate against individuals based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or other malicious code that will or may affect the functionality of this website, or the internet; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or unethical purpose; or (k) to interfere with or bypass the security features of this service, related websites, or the internet. We reserve the right to terminate your use of this service or any related website if you violate any of these prohibited uses.

10.1. Any external links that are provided on the website are done so to allow functionality with our third-party payment extension or for the user’s convenience. 11.1. Infinite Recreations provides no guarantees, warranties, or representations regarding the website or the accessing thereof.

1. Disclaimer of Liability

12.1. Infinite Recreations, including our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, and service providers, shall not be held responsible or liable for any loss, liability, direct or indirect damage, personal injury, or expense that you or any third party (including your company or company representation) may suffer as a result of, or in connection with, your access and use of the website, any information on the website, your or your company’s personal information, or material and information transmitted through our system. 

Specifically, neither Infinite Recreations nor any third-party service provider shall be liable in any way to you or any other person, firm, or corporation for any loss, liability, direct or consequential damage, personal injury, or expense arising from delays, inaccuracies, errors, omissions in any price information or its transmission, actions taken in reliance on such information, or any non-performance, interruption, or termination thereof.

Customers are reminded that Infinite Recreations has all required measures in place to encrypt and protect personal information that is submitted by a customer. However, due to the interactive nature of some of our products such as the ICE SmartTag, we provide no guarantees that your personal information will not be shared should a 3^rd party tap your ICE SmartTag device and gain access to the page showing your information, or in the event that any product purchased from Infinite Recreations is stolen, lost, or by any other means not in the possession of the intended person (the specific Profile Owner).

1. Conflict of Terms

13.1. If there is a conflict or contradiction between the provisions of these website terms and conditions and any other relevant terms and conditions, policies or notices, the other relevant terms and conditions, policies or notices which relate specifically to a particular section or module of the website shall prevail in respect of your use of the relevant section or module of the website.

1. Severability

14.1. Any term, policy, or notice that is or becomes unenforceable in any location, whether due to being void, invalid, illegal, unlawful, or for any other reason, shall only in that specific jurisdiction and only to the extent that it is unenforceable, be considered void, while the remaining provisions of the relevant terms, policies, and notices shall remain fully in effect.

1. Applicable Laws

15.1. Use of this website shall in all respects be governed by the laws of the Republic of South Africa. All parties accessing the website agree that the South African courts of law shall have exclusive jurisdiction over all controversies arising under this agreement and agree that venue is proper in those courts.

1. Warranty

16.1. Infinite Recreations offers a warranty based on poor workmanship where visible defects, breaks, cracks, or deformation is noticed on a product upon arrival. Furthermore, warranty is offered special cases and these will be managed case-for-case at the Director’s discretion. The client is encouraged to contact the Infinite Recreations team on admin@infiniterecreations.co.za. An example of such a case is where the intended function of a product does not work such as an NFC tag embedded in a keychain that does not work on arrival. In this case, the tag within the product will be repaired and supplied back to the client. 

16.2. All products are new in condition  and of good quality unless otherwise noted. Items that are not new or of the best quality will be noted as such on the product item.

16.3. Should you find a product to be defective, it must be returned to us in line with our Returns and Refunds Policy. Failure to do so may result in the return being rejected.

1. Warranty Conditions

17.1. We reserve the right to evaluate all warranty claims on a case-by-case manner and we do not give any guarantee that defective items will be replaced. All warranty items will be inspected by the Infinite Recreations team upon which a decision will be made.

17.2. All warranty claims should be communicated exclusively via email and will require a short report and videos/pictures of the perceived fault. Once the Infinite Recreations team has gone through the supplied communication, a decision will be made to retrieve the product for further testing or to disapprove the claim.

18.3. We reserve the right to refuse returns on all products that contain sealed enclosures of which the enclosure has been tampered with and/or the sticker removed. Such a product shall immediately have its warranty voided and will also be considered non-returnable and will not be eligible for exchange or refund.

17.4. We reserve the right to refuse returns on all products that have been tampered with, modified, damaged. Any such item shall immediately have its warranty voided and will also be considered non-returnable and will not be eligible for exchange or refund.

17.5. The client is encouraged to make contact with Infinite Recreations in all cases where the product is defective, if such a product contains an electrical component or device the Infinite Recreations will carefully inspect the product. If the Infinite Recreations team assesses the product as defective, the client will be given the choice to either replace, repair or request a refund. This is only applicable in cases where items have not been damaged by the user as mentioned in 18.3 and 18.4.

17.6. Should a product be found not defective, the customer will be responsible for the collection and return shipping costs, as well as any other applicable costs in the policy.

1. Order Cancellation Policy

18.1 Infinite Recreations reserves the right to refuse the cancellation of any order of which the items have already entered the manufacturing or packaging process. We encourage all customers who place orders to ensure that all products and items that are in the basket are correct before checking out and making payment. We further encourage customers to meticulously check the order details to ensure that the content is correct, including the order quantities, shipping address and other contact details.

18.2 Should a customer wish to cancel an order, kindly make contact as soon as possible and the Infinite Recreations team will try their best to assist, provided that the order has not started processing.

18.3 Any and all concerns regarding our cancellation policy should be sent to the Infinite recreations team.

1. Processing of orders

19.1. All orders placed on the website will have a standard fulfillment duration of 10 business days excluding shipping. Orders may be fulfilled faster than this depending on order quantity, order queues, availability of materials and items needed to manufacture the ordered products.

19.2. Infinite Recreations reserves the right to increase the standard fulfillment duration should it be required due to the demand placed on the manufacturing process. Clients will be handled on a first payment first process basis and all customers whose orders may fall outside the 10 day period will be contacted via email. 

19.3. Infinite Recreations reserves the right to temporarily limit the purchasing of products should this be necessary for any reason whatsoever.

1. Shipping

20.1. Orders that have completed the manufacturing and packing process will be shipped the next day.

20.2. Delivery time may vary depending on which area items are being delivered to, but typical delivery times are between 2 and 4 working days.

20.3. Infinite Recreations reserves the right to not take any responsibility for any delays that are encountered with the delivery of the order once the order has been handed over to the courier service. Infinite Recreations will assist with contact to the courier service but will not be held liable in any way whatsoever for any losses or damages of any kind incurred due to late delivery.

20.4 We reserve the right to make changes to the delivery fees charged to customers at any point without prior notice.

20.3 Customers will receive email notification once the order has been shipped, which will include any tracking and shipping information required for the successful delivery.

1. International Shipping Policy

21.1 Infinite Recreations reserves the right to select the most reputable shipping service for sales that take place internationally. Should the client not be happy with the arranged shipping service or the cost thereof, Infinite Recreations reserves the right to cancel the order.
